Een spookfactuur is het ontvangen van een factuur voor producten en/of diensten die nooit zijn geleverd. Een spookfactuur is vaak afkomstig van een oplichter. De oplichter die de factuur stuurt hoopt dat de factuur betaald wordt zonder dat er vragen naar worden gesteld tijdens de verwerking. De geleverde producten en/of diensten bestaan niet, vandaar de naam spookfactuur.
Veel voorkomende vormen van spookfacturen zijn:
Facturen waarbij de oplichter zich voordoet als een bestaand of fictief bedrijf, waar je wordt gevraagd om contributie te betalen.
Aanbiedingen verkapt als factuur, vaak met bijgevoegde acceptgiro.
Facturen waarbij de ontvanger uitgelokt wordt om een telefoonnummer te bellen, waaraan hoge kosten verbonden zijn.
Wilt u achterhalen waar u de afbeelding heeft gevonden ?
1) Open Google browser
Kies “foto zoeken”.
2)
Afbeelding nu uploaden.
3) Google zoekt op het web en laat u de afbeelding zien en waar hij staat.
Kunt u de foto kosteloos gebruiken, dan weet u dat u te maken heeft met oplichters.
Zijn er Copyrights verschuldigd, dan kunt u zien hoe u deze moet betalen en aan wie.
Dan wordt meteen duidelijk of het bedrijf dat deze claimt, rechtmatig bezig is.

Findinet maakt gebruik van afbeeldingen die gevonden zijn op de website PIXABAY.
Op Pixabay staan namelijk afbeeldingen waarvoor geen copyrights verschuldigd zijn.
Toch ontving de redactie recent een boete vanwege het schenden van copyrights.
De boete was uitgeschreven door Copytrack GmbH.
Wat blijkt :
COPYTRACK gaat er van uit dat de ontvanger van de boete, deze ogenblikkelijk zal betalen. Het gaat dan om fikse bedragen :

We, COPYTRACK, are writing to you on behalf of our client imageBROKER – EXCLUSIV, whose license and image rights, limited to the territory of the Federal Republic of Germany, we are here to protect – abroad this is done by our local lawyer partners. Our customer has informed us that findinet.nl is likely using an image without permission and has exclusively commissioned us with the clarification, administration of the image rights and, if necessary, the enforcement of any copyright infringement. Images are protected by copyright law and infringements are actionable under national and international law. Please see the attachment below for details.
On behalf of our client, we must first determine if you have a valid license to use the images in question. If you have a valid license to use these images, please reply to this email and include proof of purchase and any other license information.
Please respond to this letter no later than July 16, 2023.
If this is not the case, your use of the image material most likely constitutes a copyright infringement on the territory of the Federal Republic of Germany – abroad, our local lawyer partners will check this – and you would then be legally obligated to compensate our customer for the damage caused by this copyright infringement.

This case will not go away if you ignore it. Rather, it will escalate to litigation in which our partner lawyers may seek either our client’s lost licensing fee plus your profits from the Offending Use(s) (see 17 U.S.C. § 504), or statutory damages in an amount up to $150,000.00 in connection with the infringement at issue, as well as costs and attorney fees, assuming timely registration. Id at § 505. Moreover, 17 U.S.C. §1203(c)(3) permits our client to “recover an award of statutory damages for each violation of Section 1202 in the sum of not less than $2,500 or more than $25,000.” And under the relevant authorities, each copy or reproduction would be a separate violation. Our client will seek such damages through litigation should this matter not be appropriately resolved.

Naar aanleiding van jullie bericht ‘Copytrack is cybercrime’:
Ook ik kreeg een dwingende mail van Copytrack.
In mijn geval ging om foto’s die ik mijn toenmalige grafisch ontwerper op mijn website had gezet, dus ik had er voor betaald.
Maar ik schrok wel: hoe zat dat precies in elkaar?
Mede door jullie bericht besloot ik ze een koekje van eigen deeg te geven en hen te vragen naar hun machtiging, een termijn te stellen en wat meer van dat soort dingen.
Toen kreeg ik al heel snel bericht dat ze de claim introkken. Inmiddels heb ik alle foto’s op m’n site vervangen door nieuwe foto’s van Pixabay en een printscreen gemaakt vóór het downloaden, zodat ik bewijs heb dat het gaat om rechtenvrije foto’s.
